    Sick Leave and Worker's Compensation

    1. An employee who sustains an accidental injury arising out of and in the course of his/her employment with DAOES (herein after referred to as "injury"), may be entitled to compensation under the Illinois Workers' Compensation Act, (820 ILCS 305/1, et seq. (hereinafter referred to as the "Act".) An employee who believes he/she is entitled to compensation under the Act shall comply with all the requirements of the Act.
    2. An employee who sustains an injury, requiring the employee to be absent from work, may be entitled to certain sick leave benefits for such injury.
    3. An employee who sustains an injury, requiring the employee to be absent from work, shall be entitled to receive his/her accumulated sick leave benefits for the time he/she is absent, provided that the employee does not at any time receive compensation under the Act for temporary total disability for such injury. If an employee at any time receives compensation under the Act for temporary total disability for such injury, the employee shall be entitled to that portion of his accumulated sick leave benefits that will bring the weekly compensation under the Act for temporary total disability for the period the employee is absent from work up to the employee's Average Weekly Wage (as defined in Section 10 of the Act) at the time of the injury. The portion of sick leave benefits received by an employee for an injury shall be deducted from said employee's accumulated sick leave.
    4. In the event DAOES pays an employee sick leave benefits for an injury and the employee subsequently receives compensation under the Act for temporary total disability for such injury, and the sum of the sick leave benefits and compensation under the Act for total temporary disability is greater than the benefits the employee is entitled to under the terms of this policy, then DAOES shall be entitled to deduct from the employee's wages the amount equal to the excess sick leave benefits paid to the employee.

    Medical Benefits and Workers' Compensation

    1. An employee who sustains an injury shall not be entitled to any medical, surgical, hospital, temporary disability or accidental disability benefits pursuant to any informal plan contributed wholly or partially by DAOES for the same injury.
    2. An employee who sustains an injury and is entitled to compensation under the Act and prior to the receipt of such compensation, the employee receives medical, surgical, hospital temporary disability, or accidental disability benefits pursuant to a formal or informal plan contributed wholly or partially by DAOES, for such injury, DAOES shall receive a credit for such payments toward the payment of compensation under the Act. In no event shall the employee receive medical, surgical, hospital, temporary disability or accidental disability benefits in excess of the compensation entitled to the employee under the Act.
